This website is operated by Arecah, trading as Big Dog Things. Throughout the site, "we", "us" and "our" refer to Big Dog Things. We offer this website, including all information, tools and services available on it, to you, the user, on the condition that you accept all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following Terms of Service ("Terms"), including any additional terms and policies referenced here or linked from this page. These Terms apply to all users of the site, including browsers, customers, and anyone contributing content (such as reviews).

Please read these Terms carefully before using our website. If you don't agree with any part of these Terms, please don't use the site. Any new features or tools added to the store are also subject to these Terms. We may update these Terms from time to time by posting changes to our website — it's your responsibility to check this page periodically, and continuing to use the site after changes are posted means you accept them.

We sell to customers within Australia. Our store is hosted on Shopify Inc., which provides the e-commerce platform we use to sell our products and services to you.

Section 1 — Online store terms

By agreeing to these Terms, you confirm that you are at least 18 (the age of majority in Australia), or that you have parental/guardian consent to use the site if you are a minor.

You may not use our products for any unlawful or unauthorised purpose, nor may you, in using the Service, violate any laws applicable in your state or territory (including copyright law). You must not transmit any worms, viruses, or code of a destructive nature. A breach of these Terms may result in immediate termination of your access to our Services.

Section 2 — General conditions

We reserve the right to refuse service to anyone, at any time, for a lawful reason.

Content you submit (excluding payment card details) may be transmitted unencrypted and may involve transmission over various networks, and adaptation to the technical requirements of connecting networks or devices. Payment card information is always encrypted during transfer.

You agree not to reproduce, duplicate, copy, sell, resell or otherwise exploit any part of the Service, or access to it, without our express written permission.

Headings in these Terms are for convenience only and don't affect their interpretation.

Section 3 — Accuracy, completeness and timeliness of information

We aim to keep the information on this site accurate and current, but material on the site is provided for general information only. Any reliance you place on it is at your own discretion. This doesn't limit or exclude your rights under the Australian Consumer Law (see Section 13).

This site may contain historical information provided for reference only. We reserve the right to modify the site's content at any time.

Section 4 — Modifications to the Service and prices

Prices for our products may change without notice, and we reserve the right to modify or discontinue any part of the Service without notice. We won't be liable to you or any third party for a modification, price change, suspension or discontinuance of the Service, except where liability cannot be excluded under Australian law.

Section 5 — Products or Services

Certain products may be available exclusively online and in limited quantities. Products are subject to return or exchange in line with our Refund and Return Policy.

We do our best to accurately display the colours and images of our products, but we can't guarantee that your device's display will be perfectly accurate.

We reserve the right, but are not obligated, to limit sales of our products to any person, region, or jurisdiction, and to limit quantities of any product we offer. Product descriptions and pricing are subject to change at any time without notice. We reserve the right to discontinue any product at any time.

Section 6 — Accuracy of billing and account information

We reserve the right to refuse or cancel any order, including in cases where we reasonably suspect fraud, unauthorised or illegal activity, or bulk/reseller purchasing. If we cancel or change an order, we'll try to notify you using the email, phone or billing details provided when the order was placed.

You agree to provide current, complete and accurate information for all purchases, and to keep your account and contact details up to date so we can process your order and get in touch if needed.

Section 7 — Optional tools

We may give you access to third-party tools that we don't monitor or control. You acknowledge that we provide access to such tools "as is" and "as available," without any warranty, and that your use of them is at your own risk. You should review and understand the third party's own terms before using their tools. We may also offer new features or services in future, which will also be subject to these Terms.

Section 8 — Third-party links

Some content or products on our site may come from, or link to, third parties not affiliated with us. We're not responsible for the accuracy of third-party content, and we don't accept liability for products, services or content of third parties, to the extent permitted by law. Please review the third party's own policies before engaging in any transaction with them, and direct any complaints about a third party's product or service to them directly.

Section 9 — User comments, feedback and other submissions

If you send us comments, suggestions, reviews or other content — whether we asked for it or not — you agree that we may edit, copy, publish, distribute and otherwise use it, in any medium, without compensation to you. We're under no obligation to keep your comments confidential or to respond to them.

We may (but aren't obliged to) monitor, edit or remove content we consider unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable, or that breaches someone else's rights or these Terms.

You agree that anything you submit won't infringe anyone else's rights (including copyright, trademark or privacy), won't be unlawful, abusive, defamatory or obscene, and won't contain viruses or malware. You won't use a false email address or impersonate someone else. You're solely responsible for your own comments, and we accept no liability for comments posted by you or any third party.

Your personal information is handled in line with our Privacy Policy.

Section 11 — Errors, inaccuracies and omissions

Occasionally the site may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct these and to update information or cancel orders affected by an error, at any time, including after you've placed an order — we'll always let you know if this affects an order you've placed. We're under no obligation to update or clarify information on the site except where required by law.

Section 12 — Prohibited uses

You may not use the site or its content: (a) for an unlawful purpose; (b) to solicit others to perform unlawful acts; (c) to violate any Australian or other applicable law or regulation; (d) to infringe our intellectual property or anyone else's; (e) to harass, abuse, defame, or discriminate against anyone; (f) to submit false or misleading information; (g) to upload viruses or malicious code; (h) to collect or track others' personal information without consent; (i) to spam, phish, or scrape the site; (j) for any obscene or unlawful purpose; or (k) to interfere with or bypass the security features of the Service. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law or other applicable law that cannot be excluded, restricted or modified. Where our goods or services fail to meet a consumer guarantee, you're entitled to the remedies set out in our Refund and Return Policy and under the Australian Consumer Law.

Subject to that, and to the fullest extent permitted by law:

  • We don't guarantee that use of the Service will be uninterrupted, timely, secure, or error-free.
  • The Service and any products or services delivered through it are provided "as is" and "as available."
  • To the extent permitted by law, our liability for any loss or damage arising from your use of the Service is limited to, at our option, resupplying the relevant service or refunding the amount you paid for it.

Nothing in this section limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited or excluded under Australian law.

Section 14 — Indemnification

You agree to indemnify and hold us, our officers, directors, employees, agents, contractors and suppliers harmless from any claim or demand (including reasonable legal fees) made by a third party arising from your breach of these Terms or your violation of any law or a third party's rights, except to the extent caused by our own negligence or breach of these Terms.

Section 15 — Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in full force and effect.

Section 16 — Termination

Obligations incurred prior to termination survive termination of this agreement. These Terms remain effective until terminated by you or us. You may stop using our Services at any time. We may suspend or terminate your access if we reasonably believe you've breached these Terms, and you'll remain responsible for any amounts already due.

Section 17 — Entire agreement

Our failure to enforce a right or provision of these Terms doesn't waive that right or provision. These Terms, together with any policies posted on our site, form the entire agreement between you and us regarding use of the Service, and supersede any prior agreements or communications on the subject.

Section 18 — Governing law

These Terms are governed by the laws of New South Wales, Australia, and any disputes will be subject to the non-exclusive jurisdiction of the courts of New South Wales — please confirm this is the correct state for Arecah's registration.

Section 19 — Changes to these Terms

We may update these Terms at any time by posting changes to this page. It's your responsibility to check this page periodically. Continuing to use the site after changes are posted means you accept the updated Terms.
